Contract for the transfer of rights of the winning design (1st place)
Contest holder:

On «date» the following agreements are governed by contract between «address and contact of contest holder»
(hereinafter referred to as contest holders) and «Company - first name, last name» (hereinafter referred to as designer).
The two parties assure:
§1 File formats to be transmitted
The designer provides all file formats to the contest holder that are defined in the briefing of the project «name of project». This has to take place within 3 days after announcement of a possible nomination or a possible winnings.
§2 Details on the design
a)The designer assures that he has used no design elements of third parties
with the exeption of the material provided by the contest holder for developping the designs and that the design
was solely created by him without copying parts or whole designs of others. Furthermore, the designer assures that he
did not violate existing patents, Copyrights, trade secrets or other proprietary rights of third parties, companies
or institutions and no infringements of other contracts, agreements or covenants are commited by conclusion of this contract.
b)In the event that the designer uses design elements of third parties, he has to inform the contest holder already at
submission about possible restrictions of use or fees.
§3 Transfer of rights
In waiver of the right of nomination of author rights, the designer transfers all rights of use and enjoyment to the contest holder , without time and place constraint, as well as the right to modification and further transmission. The designer is not allowed to use the design in future work or to sell the design again. The only exception is the use of design as a reference in workbooks and portfolios. Design elements are excluded of the transfer of all rights under §2b.
All agreements made here apply to the design graphically shown below:
